We operate Instant Checkout, Instant Audiences, Instant SMS and the other products and services offered by us (together, the Instant Products), which are designed for use by customers (you, End User) of e-commerce merchants that have entered into an agreement with us to install and operate the Instant Products (Merchant) on their e-commerce website/s (each, a Merchant Website). Who we are and how to contact us

The purposes for which we collect your personal information

We will collect personal information about you in order to operate the Instant Products for the benefit of End Users and Merchants, to enforce our legal rights and comply with our legal obligations. For the purposes of the Instant Products, we will collect your personal information in the following ways:

  1. when you register an End User account on Instant Checkout (Instant Account); 

  2. when you contact us for technical support and assistance with your Instant Account or the Instant Products;

  3. via cookies and pixels installed on Merchant Websites, when you attend at, browse and/or make selections on a Merchant Website; and

  4. when you submit an enquiry using the form on our website.

Personal information about End Users is also generated by our profile building technology, such as information about your shopping habits as determined by those algorithms.  

We need the information in order to (a) operate and grow our business, provide, administer and optimise the Instant Products, and to enable us to operate our IT systems and networks, manage our hosting environments and ensure the successful delivery of our products and services to Merchants and End Users; (b) to identify you; and (c) to enforce our legal rights and for the other reasons set out in our Privacy Policy. 

We may use your personal information, to send marketing communications to End Users on behalf of Merchants about Merchant products and services that the relevant Merchant thinks they may be interested in. If an End User signs up to receive marketing communications from us on behalf of a Merchant, they can opt-out at any time by clicking the unsubscribe link at the bottom of the message, or by logging into their account on Instant Checkout to update their marketing preferences.

Consequences of not providing the personal information

You cannot use the Instant Products on an anonymous basis. You have the option of not identifying yourself or using a pseudonym when you contact us to enquire about our products and services or when you otherwise wish to browse our website.

Other entities, bodies or persons to which the personal information is usually disclosed

We will disclose your personal information, to Merchants and their personnel that require it; to our legal, accounting or financial advisers, insurers and debt collectors and otherwise as required to enforce our legal rights or comply with applicable law, and for the other reasons set out in our Privacy Policy.

Accessing and correcting your personal information

You can apply to access and/or correct the personal information that we hold about you. Our Privacy Policy contains information about how you may access the personal information that we hold about you and seek the correction of such information.

Complaints

Our Privacy Policy contains information about how you may complain about a breach of privacy law and how we will deal with such a complaint.

Disclosure of personal information to overseas recipients

Provided that we comply with applicable law, we may transfer your personal information to our contractors and service providers who assist us with the operation of the Instant Products and our website, and to assist us with the operation of our business generally, where we consider it necessary for them to provide that assistance.
